• your reliance upon any content within the application;

• employment decisions;

• any other consequence arising from your use of the application.

This release applies regardless of the legal theory asserted, including contract, tort (including negligence), statutory claims, or any other theory of liability, to the fullest extent permitted by law.

Nothing in this waiver releases liability for conduct that cannot legally be waived under applicable law, including intentional misconduct, fraud, willful and wanton conduct, or any liability that Illinois or federal law prohibits from being waived.

You acknowledge that this waiver is a material condition of your use of DutyReady-365 and that DutyReady-365 would not make the application available to you on the same terms without your agreement to this waiver.

9. Limitation of Liability

To the fullest extent permitted by law, the Released Parties shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or economic damages, including lost income, lost employment opportunities, lost certifications, lost licenses, lost educational opportunities, lost business opportunities, emotional distress, or any other losses arising from or relating to your use of DutyReady-365, even if advised of the possibility of such damages.

If a court determines that any limitation of liability in this policy is unenforceable, the remaining provisions shall continue in effect to the fullest extent permitted by law.

10. Governing Law

This Liability Waiver and Disclaimer shall be governed by and interpreted in accordance with the laws of the State of Illinois and applicable federal law, without regard to conflict-of-law principles.

11. Severability

If any provision of this Liability Waiver and Disclaimer is determined to be invalid, illegal, or unenforceable under applicable law, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

12. Voluntary Agreement
