Terms of Use

1. Acceptance of These Terms

These Terms of Use govern your access to and use of DutyReady-365 (the “Service”), including all study sets, flashcards, learn sessions, practice tests, scenario modules, and final exam tools.

By creating an account, purchasing access, or using any part of the Service, you agree to these Terms and to the DutyReady-365 Study Resource Liability Waiver & Disclaimer, which is incorporated here by reference. If you do not agree, do not use the Service.

2. Eligibility and Account Registration

To use the Service you must:

• be at least 18 years of age;
• provide accurate registration information;
• maintain the confidentiality of your login credentials; and
• accept responsibility for all activity that occurs under your account.

You must notify DutyReady-365 immediately if you believe your account has been accessed without your authorization.

3. Purchase, Access Term, and Renewal

Access to the Service is sold as a one-year term. Your access begins when payment is completed and ends at the conclusion of the stated access term shown in your account.

Pricing is set at the time of purchase and may change for future purchasers. Continued access after the term ends requires renewal at the then-current rate.

4. Refunds

Because the Service delivers immediate and complete access to digital study material upon purchase, all sales are final and payments are non-refundable except where required by applicable law.

5. Single-User, Single-Device License

Your purchase grants a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own individual exam preparation.

Accounts are for one person only. The Service enforces single-device access and records device and session activity to detect credential sharing. You may not:

• share, sell, lend, or transfer your login credentials to any other person;
• allow more than one person to study under a single account;
• distribute, resell, or republish any portion of the study material; or
• use the Service on behalf of a group, class, department, or organization without written permission.

6. Prohibited Conduct

You agree not to:

• copy, scrape, screenshot, record, export, or otherwise reproduce content from the Service;
• circumvent or attempt to circumvent content protection, watermarking, device locking, or authentication measures;
• reverse engineer, decompile, probe, or attack the Service or its infrastructure;
• upload malicious code or interfere with other users' access; or
• use automated tools to access, harvest, or index the Service.

Violations may result in immediate suspension or termination without refund, and may be referred for legal action.

7. Intellectual Property

The Service, its organization, compilation, question sets, explanations, design, branding, and software are owned by DutyReady-365 and protected by applicable intellectual property laws.

Source material referenced in the Service — including departmental orders, manuals, bulletins, and directives — remains the property of its respective issuing authority. DutyReady-365 is not affiliated with, endorsed by, or acting on behalf of any fire department, testing authority, or certifying body.

8. Accuracy of Content

Study content is compiled from source material believed to be accurate at the time of compilation. Standards, orders, and testing content change. The Service is a supplemental study aid only and is not a substitute for official training, current orders, or official study materials.

Information based on the 2019 examination will be adjusted as new material is released.

9. No Guarantee of Results

DutyReady-365 makes no representation, warranty, or guarantee that you will pass any examination or obtain any certification, license, score, promotion, or employment outcome. See the Liability Waiver & Disclaimer for the full statement.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. DutyReady-365 does not warrant uninterrupted or error-free operation.

11. Limitation of Liability

To the maximum extent permitted by law, DutyReady-365 and its owners, operators, and contributors shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including lost opportunities, lost promotions, lost wages, or exam results.

Total aggregate liability for any claim relating to the Service shall not exceed the amount you paid for access during the twelve months preceding the claim.

12. Suspension and Termination

DutyReady-365 may suspend or terminate your access at any time, without refund, if it reasonably determines that you have violated these Terms, shared account access, attempted to copy or redistribute content, or compromised the security of the Service.

13. Changes to the Service and These Terms

DutyReady-365 may modify, add, or remove features and content at any time, and may update these Terms. Material changes take effect when posted on this page. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute shall be brought exclusively in the state or federal courts located in Illinois, and you consent to that jurisdiction and venue.

15. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. These Terms, together with the Liability Waiver & Disclaimer, constitute the entire agreement between you and DutyReady-365 regarding the Service.
